China's automotive giant, SAIC Motor, has announced its decision to challenge the European Commission at the European Court of Justice over the recent imposition of 45% tariffs on its electric vehicles. This development, revealed on Wednesday, threatens to further escalate global trade tensions, Euronews reports.
The action follows China's official legal move at the World Trade Organisation (WTO) concerning an EU investigation deemed 'fact-based' and 'anti-subsidy' by the Commission. Brussels accuses Beijing of providing excessive subsidies to its electric car sector, allegedly allowing Chinese manufacturers to sell vehicles at artificially low prices in international markets.
The EU has instituted these new tariffs, effective Wednesday, to counterbalance these purported subsidies and to level the playing field for competition. Of all Chinese car manufacturers, the state-run SAIC faces the highest tariff of 35.3%, excluding an existing 10% baseline rate.
In a formal statement, SAIC Motor expressed deep regret over the Commission's final decision, emphasizing its commitment to defending its 'legitimate rights and interests' through legal proceedings. The carmaker criticized the EU's investigation for wrongly assessing subsidies and neglecting critical information provided by the company.
SAIC contends that the tariffs will inflate car prices for European consumers and impede the adoption of electric vehicles, while it is already taking proactive measures such as designing new models specifically for the European market. The tariffs are slated for a five-year duration unless EU and Chinese officials negotiate a minimum price agreement—an intricate solution still under consideration.
Trade Retaliations and Investigations
In a parallel vein, Beijing has signaled possible retaliatory measures targeting the EU's dairy, brandy, and pork industries. Brussels, in turn, has dismissed these threats as 'unwarranted' and has initiated legal actions at the WTO against the dairy and brandy measures.
Amid this trade conflict, the EU has launched an anti-dumping investigation into Chinese imports of choline chloride—a critical chemical used in animal feed—following evidence presented by the European sector about detrimental impacts from purportedly unfair Chinese trade practices.
A European Commission spokesperson elucidated that this investigation will evaluate whether measures are warranted to mitigate the alleged unfair practices, with all EU enterprises involved being invited to partake in the inquiry. The conclusion of this probe could lead to provisional measures in as soon as eight months, and definitive measures could take up to 14 months to implement.
