FTC Issuing Refunds in Fashion Nova Negative Reviews Settlement

The Federal Trade Commission (FTC) is making headlines by distributing over 148,000 refunds amounting to nearly $2.4 million as part of a settlement with online fast fashion retailer, Fashion Nova. The retailer has been accused of hiding negative reviews from its website. For more details, the original report can be found on Fox Business.

According to FTC's data, which aligns with information available on the IndexBox platform, Illinois had the largest number of refund recipients, over 25,000, among a total of 148,351 recipients countrywide. The median refund amount issued was $16. To qualify for a refund, consumers were required to file a "valid claim" by the August 15, 2023, deadline, with eligible purchases made before November 21, 2019.

This settlement marks a significant precedent as it is the FTC's first case involving the suppression of negative reviews. The commission initiated its complaint against Fashion Nova in January 2022, accusing the retailer of refusing to publish reviews with ratings lower than four stars, which they claimed was "false or misleading" about their products.

In a final order, Fashion Nova is now prohibited from concealing reviews or endorsements and must disclose all reviews regardless of their rating. The retailer has also been fined $4.2 million. This comes after a prior settlement in April 2020, wherein Fashion Nova paid $9.3 million over allegations of untimely shipments and improperly handling unshipped merchandise.

As the FTC continues to monitor e-commerce practices, this case serves as a cautionary tale for other retailers about the importance of transparency in online reviews.
