The U.S. Federal Trade Commission (FTC) has filed a lawsuit against Southern Glazers, the largest liquor distributor in the United States, accusing the company of implementing pricing practices that unfairly favor its largest clients at the expense of smaller retailers. Southern Glazers distributes well-known alcoholic brands such as Bacardi, Smirnoff, and Jim Beam. The FTC alleges that the company has been providing exclusive discounts to major clients such as Costco, Kroger, and Total Wine & More since at least 2018, leaving smaller independent liquor shops at a competitive disadvantage. According to outgoing FTC Chair Lina Khan, such practices limit consumer choices and can lead to higher prices and community suffering.
Despite the lawsuit, opposing voices within the FTC, such as Republican Commissioners Andrew Ferguson and Melissa Holyoak, have raised concerns about the merit and potential impact of the case. Holyoak argued that the business practices under scrutiny do not necessarily harm competition, while Ferguson expressed doubts about the Commission's likelihood of success and the strategic use of its enforcement resources.
The lawsuit comes at a time when the U.S. spirits and liqueurs market sees significant activity. According to IndexBox, the United States imported spirits and liqueurs valued at USD 11.1 billion in 2023. Mexico stood as the largest import partner, with a trade value of USD 4.8 billion, followed by France (USD 2.1 billion) and the United Kingdom (USD 1.9 billion).
