As the United States anticipates a more business-friendly regulatory environment under President Donald Trump's administration, corporate leaders remain optimistic about potential deregulation initiatives that could reduce bureaucratic hurdles. The annual average of new bank charter applications approved between 2010 and 2023 stood at a mere five, a stark contrast to the 144 per year from 2000 to 2007. Such numbers underscore the industry's struggle under the weight of intensive regulatory demands and a cautious stance following the 2008 financial crisis.

The Federal Deposit Insurance Corporation (FDIC), alongside the Federal Reserve and the Office of the Comptroller of the Currency, plays a crucial role in the regulatory oversight of the banking system. Earlier this month, Travis Hill, the FDIC's acting chair, emphasized the agency's commitment to encouraging new firms to seek bank charters, ensuring a robust influx of entrants into the sector.

Addressing the challenges faced by new banks, the lawyer group advises regulatory bodies to establish realistic success benchmarks and accept the potential risk of failure as a fact of doing business in the banking sector. The letter critiques the current expectation that applications should nearly guarantee success, arguing it sets an unreasonably high bar.
