Montero Mining Settles with Tanzania for $27 Million

Montero Mining and Exploration Ltd., listed on the TSX Venture Exchange under the ticker MON, has reached a settlement with the Tanzanian government over the Wigu Hill rare earth element project. The settlement, amounting to $27 million, will be disbursed in three instalments, a figure considerably less than the initial claim of C$90 million the company sought through arbitration (source).

Montero's conflict with Tanzania began when the company's renewed licence on the Wigu Hill project was invalidated in 2018 due to a change in the mining code that eliminated the 'retention licence' classification. The company initially started exploring Wigu Hill in 2008 and was awarded the retention licence in 2015, a status removed when the Tanzanian Mining Commission in 2019 announced a tender for joint development of former retention licence areas, effectively nullifying Montero's claims.

Despite several attempts by Montero to reach a resolution, the legal journey led them through arbitration with the International Centre for Settlement of Investment Disputes. As part of the settlement, Montero's CEO, Dr. Tony Harwood, expressed optimism for Tanzanian mining ventures saying, “We wish Tanzania success in attracting new mining investments and look forward to receiving the final two payments due within the next 5 weeks.” However, after settling legal and funding costs, the company will net only about $14.5 million.

Industry Perspective

The mining sector in Tanzania has seen a series of arbitration cases, and settlements including Indiana Resources' winning of US$109.5 million and Winshear Gold's $30 million settlement, illustrating a trend of disputes following legal reforms in the African country's mining legislation. The settlement for Montero marks a significant reduction from its original claim, reflecting ongoing challenges for mining firms combating regulatory uncertainties in emerging markets.

Montero's Future Prospects

With the dispute behind it, Montero is turning its focus towards Chile, where it holds the Avispa copper-molybdenum project. The company is actively seeking a joint venture partner to further develop this asset. Following the settlement announcement, Montero's shares saw a rise of 3.2% to C$0.32, boosting its market capitalization to C$15.6 million ($10.8 million).
