Netherlands Expands Investment Screening to AI and Biotech

The Dutch government has announced plans to extend its investment screening law by incorporating advanced technologies such as biotechnology and artificial intelligence, aiming to protect national security. The full report can be accessed here.

According to Economy Minister Dirk Beljaarts, the international security situation has seen significant deterioration over recent years, making this move crucial for safeguarding against hybrid threats, including cyber operations and espionage. The law seeks to ensure the protection of Dutch entrepreneurs and their innovative contributions, which are integral to the nation's economic future.

In addition to AI and biotechnology, the law will cover nanotechnology, sensor and navigation technology, advanced materials, and nuclear technologies for medical use. The integration of these technologies is projected to occur in the latter half of 2025.

Initially introduced last year, the screening law mandates that any plans to acquire key Dutch infrastructure, real estate, or technology must be reported to the Investment Review Office. The office has a period of eight weeks to six months to review and advise the government on any security concerns related to such investments.
