The ongoing debate in the United States over the H-1B visa program continues to highlight the tech industry's reliance on imported labor, a fact exemplified by consistent demand for these visas to bring skilled foreign workers into American companies. According to data from the IndexBox platform, tech giants like Amazon, Google, and Tesla, along with Cognizant Technology Solutions, Tata Consultancy Services, and HCL America, are among the heavy users of H-1B visas. These visas, created by Congress in 1990, are intended as a primary channel for highly skilled professionals to enter the U.S. workforce, especially in sectors such as software development, computer science, and engineering. This demand is further driven by a skills gap in U.S. STEM fields, a trend that has persisted despite the number of software developers in the U.S. quadrupling to 2.85 million from 1990 to 2023.

The H-1B program, however, has been criticized for allowing companies to offer wages below local median levels due to loopholes in 'prevailing wage' requirements, as highlighted in a 2020 Economic Policy Institute paper. Despite attempts to reform wage structures under the Trump administration, these changes did not come into effect under President Biden's tenure.

Gaurav Khanna from the University of California, San Diego, noted that more H-1B visas contribute to increased U.S. patents and potentially higher incomes for workers in both the U.S. and India. Yet the debate over prioritizing domestic employment versus leveraging global talent continues unabated.
